To sell tobacco products and electronic cigarettes in NYC, you must have the relevant licenses and registration from the City and the State. This is true regardless of the contents of e-cigarette products, such as nicotine, CBD, and essential oils.

Tobacco retailers may only sell tobacco products that are unflavored or have these tastes or aromas:

• Menthol
• Mint
• Tobacco
• Wintergreen

E-cigarette retailers may only sell e-cigarettes, e-liquids or liquid nicotine that is tobacco-flavored or unflavored.

This includes e-cigarette products that are:

• Disposable
• Refillable
• Tank-based

The law applies even if the product doesn’t contain nicotine.
